Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Adaptify platform provided by Adaptify Education ("Adaptify", "we", "us", or "our"). By creating an account or using the service, you agree to these Terms. If you are using Adaptify on behalf of a school or organisation, you confirm that you have authority to bind that organisation to these Terms.

1. The Service

Adaptify is a platform that helps educators transform existing teaching materials into accessible, learner-tailored resources. You upload documents, and the platform uses automated processing and artificial intelligence to extract, adapt, and format content for learners with a range of accessibility needs.

We may update, improve, or change features of the service over time. We aim to give reasonable notice of material changes that affect how you use the platform.

2. Accounts and Eligibility

Adaptify is intended for use by educators and education professionals aged 18 or over. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information when registering and keep it up to date.

3. Ownership of Your Content and Generated Resources

You own your content. You retain all ownership of and intellectual property rights in the documents and materials you upload to Adaptify ("Input Content").

You own the resources we generate for you. As between you and Adaptify, you own the adapted resources, documents, and outputs that the platform generates from your Input Content ("Generated Resources"). Adaptify does not claim ownership of your Input Content or your Generated Resources. You are free to use, print, share, and distribute your Generated Resources for your educational purposes.

The licence you grant us. To operate the service, you grant Adaptify a limited, non-exclusive, worldwide licence to host, store, process, and transmit your Input Content and Generated Resources solely for the purpose of providing the service to you — for example, to extract and adapt your documents, generate outputs, and make them available to you in your account. This licence ends when you delete the relevant content or close your account, except for copies retained transiently in backups for the period described in our Data Retention Statement. We do not use your Input Content or Generated Resources to train artificial intelligence models, and we do not sell them.

What we own. Adaptify owns all rights in the platform itself — the software, user interface, underlying models, processing pipelines, curriculum and reading-level frameworks, and all related intellectual property. Nothing in these Terms transfers ownership of the platform to you.

Your responsibility for Input Content. You confirm that you have the necessary rights and permissions to upload your Input Content and to have it processed by Adaptify, and that doing so does not infringe the rights of any third party.

4. Use of Student and Personal Data

Where you use Adaptify to create resources for named learners, you act as the data controller for that personal data and Adaptify acts as your data processor. You are responsible for ensuring you have an appropriate lawful basis and authority to enter learner information, in line with your organisation's data protection policies.

We strongly recommend that you do not enter sensitive or directly identifying student information. Learner profiles are designed to work with pseudonyms (for example, initials or a reference) together with accessibility needs only. 5. Acceptable Use

You agree not to use Adaptify to:

  • Upload content you do not have the right to use, or that infringes another person's intellectual property or privacy rights
  • Upload unlawful, harmful, or abusive material
  • Attempt to gain unauthorised access to the platform, other accounts, or our systems
  • Reverse engineer, resell, or attempt to extract the underlying models or software, except to the extent this restriction is prohibited by law
  • Use the service in a way that disrupts or places an unreasonable load on our infrastructure

6. AI-Generated Output

Adaptify uses artificial intelligence to adapt and generate resources. While we work hard to produce high-quality, accurate output, automated systems can make mistakes. Generated Resources may occasionally contain errors, omissions, or inaccuracies.

You remain the professional responsible for the materials you use with learners. You should review Generated Resources for accuracy and suitability before using them in teaching. Adaptify is a tool to support educators, not a substitute for professional judgement.

7. Availability and Changes

We aim to keep the service available and reliable, but we do not guarantee uninterrupted access. We may suspend the service for maintenance, updates, or reasons outside our reasonable control. We may also add, change, or remove features.

8. Fees

Where the service is provided under a paid plan, the applicable fees, billing period, and terms will be set out at the point of purchase or in a separate agreement. Pilots and evaluations may be provided free of charge for an agreed period. Taking part in a pilot or evaluation does not commit your organisation to adopting the product; any adoption is subject to your own separate review and approval.

9. Termination

You may stop using Adaptify and request deletion of your account at any time by contacting support@adaptifyeducation.com. We may suspend or terminate access if you materially breach these Terms. On termination, we will handle your data as described in our Data Retention Statement.

10. Liability

Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud. Subject to that, Adaptify is not liable for indirect or consequential loss, and our total liability arising out of or in connection with the service is limited to the fees you paid for the service in the 12 months before the event giving rise to the claim (or, where the service was provided free of charge, to a reasonable amount).

The service is provided on a reasonable-efforts basis. Because you are responsible for reviewing Generated Resources before use (see section 6), we are not liable for decisions made or materials used without that review.

11. Governing Law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising out of or in connection with them.

12. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes by email or an in-app notice. The "last updated" date above reflects the most recent revision. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.
